Madras HC against illegal beach sand mining

  • HC orders CBI probe into 5800 crore rupees illegal sand mining in Tamil Nadu.
  • An illegality of such high magnitude could not have been committed without there being “collusion, corruption and connivance” among politicians, the executive and the private miners, the judges said.
  • There is a ban which the state government imposed on beach sand mining in 2013.
  • The judges directed the CBI to get to the bottom of the matter since an illegality of such high magnitude, involving national security concerns too due to mining of radioactive mineral monazite (considered an ore of thorium).
  • The CBI must probe whether the private miners had exported monazite to foreign countries thereby posing a threat to national security.
  • The orders were passed on a suo motu public interest litigation petition taken up by the court in 2015.
  • The 2013 ban was imposed in the State during former Chief Minister Jayalalithaa’s regime when the then Thoothukudi Collector Ashish Kumar wrote to the then Chief Secretary Sheela Balakrishnan flagging large scale illegal mining. Then, the government also appointed a special team headed by senior IAS officer Mr. Bedi to conduct a thorough inquiry and submit a report to it.
